Who can access the Austin MLS?
Per the Austin MLS Terms and Conditions of Use:
"You may only access the MLS if you are a Participant or Subscriber in good standing with ACTRIS or an Authorized Assistant designated by a Participant and registered with ACTRIS. Access is only provided to those Participants, Subscribers or Authorized Assistants who work for a real estate office open to the public or to those Participants who are appraisers certified or licensed by the Texas Appraiser Licensing and Certification Board. If you do not work for a real estate office open to the public or are not a licensed appraiser, you may not access the MLS without express written permission from ACTRIS."
The Austin/Central Texas Realty Information Service Rules and Regulations goes on to say the Austin “MLS is intended solely for use by Participants, Subscribers and Authorized Assistants in connection with the sale, lease and valuation of real property.”
These rules and regulations describe Subscriber, Participant, Authorized Assistants, and Appraiser as follows:
“Subscriber” means (a) a person who is licensed by the State of Texas to sell or lease real property and who employed by or under contract with a Participant; (b) a Participant with a valid license from the State of Texas to sell real estate that is on file with another Participant, or (c) an Appraiser who is working for another Appraiser that is a Participant or for an entity affiliated with another Appraiser that is a Participant. Subscriber must be employed by or a contractor to an office that is open to the public for the conduct of the real estate business.
“Participants” means a licensed real estate Participant, or Appraiser (a) who is a affiliated with the Austin Board of REALTORS® (Board) (b) who has applied for designated realtor status and whose Applicant Agreement has been accepted by ACTRIS and (c) who has an office or is employed by or is a contractor to an office that is open to the public for the conduct of the real estate business.
“Authorized Assistant” shall mean a person (a) who does not hold an active real estate license, (b) who is designated by a REALTOR® Participant in writing as authorized to access the MLS solely in order to provide services to the REALTOR® Participant, and (c) who has agreed in writing to maintain the confidentiality of the MLS.
“Appraiser” shall mean an appraiser certified or licensed by the Texas Appraiser Licensing and Certification Board; including an Authorized Assistant who is a Provisional Licensed Real Estate Appraiser or an Approved Appraiser Trainee (each, as defined by the Texas Appraiser Licensing and Certification Board) that has an office (or is employed by or is a contractor to an office) that is open to public for the conduct of the appraisal business).
On Austin-MLS-Info.com, we refer to ACTRIS Subscribers, Participants, Authorized Assistants, and Appraisers as "ACTRIS users".
